Oftentimes, due to circumstances beyond one's control, a borrower will fall behind on his/her mortgage payments. Due to the COVID-19 pandemic, many borrowers have temporarily or permanently lost income and are unable to make their mortgage payments. Florida’s management of unemployment claims is the worst in the U.S., greatly increasing borrowers’ financial difficulties. But things are not as they appear, and in most cases, the company that receives your mortgage payment does not actually own your mortgage loan. Instead, these companies are “mortgage servicers” – third party contractors that manage mortgage loans much the same way a property manager manages an apartment complex. Unlike the investors they work for, mortgage servicers have little incentive to avoid foreclosures.
It happens more frequently than most would expect – and far too often. Banks and mortgage servicers can, and do, regularly make serious mistakes when handling customers’ accounts. When the borrower asks the bank or mortgage servicer to correct these mistakes, they are given the runaround by an inflexible and non-responsive bureaucracy. Often, frustrated borrowers give up and pay money they do not owe simply to protect their home.
In some cases, the borrower cannot afford to pay or refuses to give in. This can result in a foreclosure lawsuit against the borrower placing them at great risk of losing their home simply because their mortgage company mishandled their payments. Even worse, there is growing evidence that these errors may not be accidents. Mortgage servicers are frequently able to profit from mishandling borrowers’ accounts. Interestingly, the mortgage companies’ “mistakes” rarely benefit the borrower, almost always favoring the bank or mortgage servicer.
